HIRE TERMS & CONDITIONS
We don't like small print any more than you do, but these terms & conditions are here to protect you as well as us! We hope that the points below are clear and understandable, but if not, then please let us know and feel free to ask any questions, we are here to help.
When hiring equipment from us you are agreeing to and are bound by these terms & conditions. 'We' or 'us' refers to dymondaudio, 'you' or 'your' refers to the hirer/signee. When hiring we may require a form of photo ID, a passport or drivers licence is preferable, in some circumstances we may request a deposit.
1: Charges
Any prices listed on this website are given as a general guide & might be changed before any final agreement is made, we will however, aim to never increase our prices without listing them on the website first. Having agreed a hiring with us, you are legally bound to pay the balance owed under that agreement on or in advance of the date specified. Where no date is specified, the whole outstanding balance of any agreed fee falls due on completion of the event. Late payment is subject to an additional charge of 5% of the overall amount.
2: Cancellation
i. If you give us less than two weeks' notice of a cancellation, then you will be legally bound to pay any agreed fee in full. ii. If you give us more than two weeks' but not more than three weeks' notice of a cancellation, then you are legally bound to pay 40% of the fee. In all our years of trading we have not once cancelled a booking or not turned up for an event, but in the extremely unlikely case that we can't meet an agreement, dymondaudio's responsibility is limited to the cost of alternative hire up to the price of your hire from us, if such a situation should occur we have a network of other hire companies who we can hire equipment from so that there is no interruption of service to you. dymondaudio are unable to accept responsibility for any other cost or losses under any circumstances. Additionally dymondaudio's responsibility is limited to providing you notice using the same scale & time frame we have applied to your liability to dymondaudio (see point 1), including force majeure.
3: Force Majeure
dymondaudio are not to be in any way liable for not supplying a service if that is because of an event that is beyond dymondaudio's control. This can include (but not limited too) acts of terrorism, social unrest, protests (political or social), extreme weather (as notified by the met office) or a natural disaster. If a local authority advises us that essential journeys are to be made only, any service we have agreed to supply, will not be thought of as essential if the safety of any of our staff or contractors could be at risk.
4: Specific Equipment
We regularly change and improve our equipment & systems in order to further improve the service and type of equipment you receive. The equipment dymondaudio supply may differ from that originally specified if we have recently changed it, but rest assured it's going to be of equal if not better quality than that originally specified. If you need to hire a specific piece of equipment then please confirm with us first before agreeing to hire from us.
5: The Condition of Equipment Supplied by dymondaudio
In situations where hire equipment is going to be used without a member of our staff or contractors in attendance, we check the physical condition and that every item is fully operational before we send them out. By accepting delivery of any equipment supplied, you are agreeing that any items are in good and fully operating condition. Although our equipment is electrically safe & well maintained (PAT certificates available on request), the performance site's electrical supply may not be. It is your responsibility to ensure the provision of a safe 240v (63/32/16/13 amp etc.) supply. Where portable generators are used, these must be regulated and adequately grounded. Please ask us if you are unsure about the power requirements of any of our equipment. We/You cannot use an unsafe socket or power supply, we strongly recommend the use of an RCD in addition to that of the main electrical supply.
6: Loss of or Damage to any Equipment
dymondaudio are unable to accept liability for any form of crowd control or the safety & security of the hirer's or third party's premises or event. You are liable to us for the full cost of any damage too or theft of our equipment at the performance site or place of storage before, during or after the event until the equipment is returned unless it arises from our own actions or negligence. It can be very expensive if somebody tips a drink over a mixing desk, or an over excited dancer knocks over a speaker or lighting system, you may need to provide protective barriers and/or insurance cover (which we strongly advise). Please ask us if you need a precise figure for insurance purposes. please ask before agreeing a hire from us if you are unsure. If we break our own equipment, we will fix it at our own expense. However, dymondaudio are unable to accept responsibility for any form of crowd control, or the safety or security of any hirer's or third party's premises/event, and the hirer is wholly liable to us for the cost of damage too or theft of our equipment at the performance site/event or at any time where the equipment is under their care i.e. on hire from us.
General
Lighting and effect equipment can get very hot, sound equipment is capable of hearing damage. You should ensure that every precaution is taken to minimise the risk to yourself, your crew, and any member of the general public, this may be by (but not limited too) erecting signs, providing safety barriers, issuing ear defenders, clear floor markings of equipment/stands, cable covers/bridges, public announcements, fire points, first aid points & marshals.
And lastly...
Any variation of the above conditions will require a specific written agreement which may be subject to a legal fee by a solicitor. Other terms & conditions may apply (regardless of if they form a part of any written agreement), but where no other written statement is available these terms will apply to any contract you may have with us.
